Above Border Privacy Statement

Above Border Inc. is based in Calgary, Canada (“Above Border”). This Policy applies to our collection, use and disclosure of your personal information in connection with your use of the Application, the Site, the Content and the Services as those terms are defined in our Terms of Use Agreement with you. Your privacy and the protection of your personal information are important to us. It is our policy to comply with applicable privacy laws and to use your personal information with your consent for reasonable purposes related to the Services, to provide you with the Services, to enhance your experience with the Above Border family of products and services, and to improve our offerings. We do not sell, rent or lease our customer lists to third parties. It is our policy to only disclose your personal information as required or authorized by law or as otherwise set out in this Policy. What is Personal Information: Personal information means information about an identifiable individual. This includes an individual’s name, home address and phone number, age, sex, marital or family status, an identifying number, financial information, educational history, etc.

Consent and Collection, Use and Disclosure of Personal Information:

Use and disclose client personal information only for the purposes for which the information was collected, except as authorized by law. For example, we may use contact information to deliver Services. The law also allows us to use that contact information for the purpose of collecting a debt owed to our organization, should that be necessary. If we wish to use or disclose your personal information for any new business purpose, we will ask for your consent. You agree that we may collect your email address(es), stored locations (whether such locations are entered by Customer or retrieved by Above Border), number of days you are present at a certain location, unique device identifiers, your preferences to provide the Services to you and any other information required to provide the Services to you as described in the Terms of Use. We may use analytics and consumer behaviour data to make the Services more convenient or more efficient, or to monitor use of the Services in order to improve the Services.

When you provide your personal information to us, you provide us with your consent to use and, to the extent reasonably required, to disclose your personal information as described in this Policy or as described in any applicable consent you may provide. Ordinarily we ask for consent to collect, use or disclose personal information, except in specific circumstances where collection, use or disclosure without consent is authorized or required by law. We may assume your consent in cases where you volunteer information for an obvious purpose. We may collect, use and disclose your personal information for the following purposes:

  • To open and manage an account for you;
  • To provide the requested Application and Services to you;
  • To develop and improve the Services to provide a better experience for you;
  • To create, manage and control your account information;
  • To communicate with you for the purpose of informing you of updates to the Application, changes or additions to the Services, Terms of Use or other policies or of the availability of any products or services we provide;
  • To assess service levels, monitor traffic patterns and measure usage of different service options;
  • To verify access rights to the Services, or other products, services or software;
  • To conduct market research from time to time;
  • To provide direct marketing of Above Border products;
  • To enforce the provisions of our legal relationship with you;
  • To respond to claims of any violation of our rights or those of any third parties;
  • To respond to your requests for the Services, including but not limited to customer service or information;
  • To protect the rights, property or personal safety of you, us, our users and the public;
  • As required or authorized by law.

Your consent may be withdrawn at any time, unless the personal information is necessary to fulfill our legal obligations. Should your consent be withdrawn, we will advise you of any consequences, which may include our being unable to provide all or part of the Application or Services to you. The law allows us to retain personal information following withdrawal of consent for reasonable business or legal purposes, following which personal information is securely destroyed or rendered anonymous. Installing and/or using the Application requires you to provide personal information as outlined in this Policy. However, the operation of the Application may result in your receiving offers, coupons or other information that we feel may be of interest to you, based on any stated preferences you may provide to us or based on your location. To cease receiving such information, you may uninstall the Application at any time. Information, including personal information, is currently stored on hosted servers.  At any time, such servers may be located outside of Canada. Subject to our policy set out below regarding updates to this Policy, and in the event that we begin to use alternate services to process or collect, use or disclose personal information about an individual on our behalf, we may notify you about such new service providers.

Security

We recognize our legal obligations to protect the personal information we have gathered about individuals and we have taken steps to ensure that we are using services that safeguard the security of personal information in our custody or control.  We protect personal information in a manner appropriate for the sensitivity of the information, including shredding paper records and permanently deleting electronic records where appropriate. We retain personal information only as long as is reasonable to fulfill the purposes for which the information was collected or for legal or business purposes. We render client personal information non-identifying, or destroy records containing personal information once the information is no longer needed. In the unfortunate event that we suffer a loss of personal information, or unauthorized access to or disclosure of personal information, we will notify any affected individuals as required by law.

Aggregated Data

"Aggregated Data" means records which have been stripped of personally identifying information, and which have been manipulated or combined to provide generalized, anonymous information. Your identity and personal information are not available in Aggregated Data. We may combine your personal information on an anonymous basis with other information to generate Aggregated Data for internal and commercial use and for sharing with affiliates, subsidiaries and business partners for planning and marketing purposes.

The Applications or Services may contain links to other sites or online resources maintained or operated by third parties. We do not control such third parties and are not responsible for the privacy practices or the content of such sites or resources. We encourage you to read the privacy policies of any such sites or resources as their privacy policies and practices may differ from our policies and practices.

Access

We make every reasonable effort to ensure that personal information is accurate and complete. Please notify us if there is a change to any personal information that may affect your relationship with Above Border. If you are aware of an error in our information about you, please let us know and we will correct it upon request wherever possible. You have the right to access your own personal information in a record that is in our custody or under our control, subject to some exceptions: for example we might refuse to provide access to information that would reveal personal information about another individual. You may make a request for access to your personal information by writing to the Above Border Privacy Officer, as identified below.  You must provide sufficient information in your request to allow us to identify the information you are seeking. You may also request information about our use of your personal information and any disclosure of that information to persons outside our organization. You may also request a correction of an error or omission in your personal information.  We may charge a reasonable fee to provide information; in such cases we will advise you of any fees that may apply before beginning to process your request.
